By accessing or using Blue Ocean IP ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Blue Ocean IP provides AI-powered intellectual property scanning, blockchain-based proof of creation, automated takedown services, trademark and patent search tools, and related services. The Service is provided "as is" and "as available" without warranties of any kind.

3. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

4. Intellectual Property

The Service and its original content, features, and functionality are owned by Blue Ocean IP, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain all rights to the content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely for the purpose of providing the Service.

5. Blockchain Records

Content hashes recorded on the blockchain are permanent and cannot be deleted or modified. By using our blockchain timestamping service, you acknowledge that the cryptographic hash of your content will be permanently recorded on the Solana blockchain. Blue Ocean IP does not store your actual content on the blockchain, only the hash.

6. Payment Terms

Paid plans are billed on a recurring basis (monthly or annually). You agree to pay all fees associated with your selected plan. Fees are non-refundable except as expressly stated in our 30-day money-back guarantee. We reserve the right to change our pricing with 30 days notice.

7. Limitation of Liability

In no event shall Blue Ocean IP, Inc., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of San Francisco County, California.
